By placing an order on thevelvetnoir.com, you confirm that you are at least 18 years of age (or the age of majority in your state, whichever is greater), have the legal capacity to enter into this agreement, and that all information you provide is accurate. We reserve the right to cancel any order where age or eligibility cannot be reasonably verified.
Product Information & Order Acceptance
We make reasonable efforts to display products accurately. Colors, sizes, and textures may vary slightly due to monitor settings or manufacturing variation. All prices are in U.S. Dollars. A binding contract is formed only when we ship your order and send a shipping confirmation. We reserve the right to refuse or cancel any order for any lawful reason, including suspected fraud, pricing errors, or stock unavailability.
Age Restriction
All products are intended for adults aged 18 and over. Our products are adult novelty items intended for personal use only. They are not medical devices and are not intended to diagnose, treat, or prevent any medical condition.
Disclaimer of Warranties
Except for the express limited warranty stated in the Warranty section, products are provided "as is." We disclaim all other warranties, express or implied, to the fullest extent permitted by law.
Limitation of Liability
To the fullest extent permitted by law, Velvet Noir's aggregate liability for any claim will not exceed the amount you paid for the product giving rise to the claim. We are not liable for indirect, incidental, or consequential damages.

Returns & Refunds
14-Day Return Window
You may request a return of eligible products within 14 calendar days after the delivery date. You must obtain a Return Merchandise Authorization (RMA) before shipping anything back to us.
What CANNOT Be Returned
For your safety and everyone else's, we do not accept returns on:
- Intimate products with the hygiene seal broken, or any sign of use
- Lingerie or underwear where the sanitary liner has been removed or the item has been worn
- Opened lubricants, oils, creams, condoms, or edibles
- Anal/insertable items — even if unopened, for safety standards
- Custom, engraved, or made-to-order items
- Items marked "Final Sale" on the product page
- Gift cards and digital products
If any of these items arrive defective or damaged, we will absolutely make it right — see the warranty section below.
What CAN Be Returned
Anything in unopened original packaging with the hygiene seal fully intact, within 14 days of delivery. This includes toys you haven't opened, unopened lingerie with the liner in place, accessories, chargers, books, and storage cases.
How to Start a Return — 3 Steps
Step 1: Email returns@thevelvetnoir.com within 14 days of delivery with your order number and the reason for return.
Step 2: We'll reply within 2 business days with a Return Authorization (RMA) number and return address. Do not ship anything back before receiving this.
Step 3: Pack securely and ship within 7 days of receiving your RMA using a trackable method. Retain your tracking number.

Original outbound shipping is non-refundable unless the return was caused by our error.
Refund Timeline
Once we receive and inspect your return, we'll issue the refund within 7 calendar days to your original payment method. Allow an additional 3–10 business days for it to appear on your statement. We'll email you when it's processed.
Shipping Policy
Discreet Packaging — Always
Every order ships in a plain box or mailer with no branding, no product images, and no wording on the outside that hints at what's inside. The sender name is a neutral shipper name, and the billing descriptor on your statement reads as a generic merchant name — not Velvet Noir.
Processing & Delivery Times
Orders placed before 2 PM ET on a business day usually ship the same day. Orders placed later, on weekends, or on holidays ship the next business day. Once shipped, you'll receive an email with tracking. Standard delivery is 3–7 business days; expedited options are available at checkout.
Lost or Missing Packages
First, check with neighbors and your mailroom — most "missing" packages turn up within 24 hours. If it's still missing after 48 hours, email support@thevelvetnoir.com with your order number. We'll file a trace with the carrier and, in most cases, send a replacement or issue a refund.
Address Changes
If your order hasn't shipped yet, email us within a few hours of placing it. Once a tracking number is generated, we cannot reroute packages.
Geographic Restrictions
We currently ship to all 50 U.S. states plus D.C. Some products may be restricted in certain states due to local law. We do not currently ship internationally or to APO/FPO addresses.
FTC Mail Order Rule
In accordance with the FTC Mail Order Rule (16 C.F.R. § 435), we will ship your order within the time stated, or within 30 days of placement. If we cannot meet that deadline, we will notify you and offer the option to agree to a new date or cancel for a full refund.
Warranty
12-Month Limited Warranty on Electronic Products
Most electronic toys come with a 12-month limited warranty against manufacturing defects from the delivery date. Premium brands may carry longer periods — see the specific warranty length on each product page.
The warranty covers: motor failure, battery/charging issues under normal use, defective seals or controls, and material defects out of the box.
The warranty does not cover: normal wear or gradual battery decline; damage from drops, heat, or incompatible lubricants (silicone lube on silicone toys degrades the surface); damage from improper cleaning or unauthorized repair; products bought from unauthorized resellers.
Defective Items
If your item arrives broken or doesn't work, email support@thevelvetnoir.com within 7 days of delivery with your order number, photos or a short video showing the issue, and a brief description. We'll arrange a free replacement, full refund (including original shipping), or store credit — whichever you prefer.
A defect means the product doesn't function as intended. It does not include subjective dissatisfaction with vibration strength, size, color, or sensation, provided the product functions as specified.
Arbitration & Dispute Resolution
Any dispute arising out of or relating to your purchase will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The Federal Arbitration Act governs the interpretation and enforcement of this agreement.
Opt-Out: You may opt out of arbitration by emailing legal@thevelvetnoir.com within 30 days of your first order. Include your name, shipping address, order number, and a statement that you wish to opt out. Opting out does not affect anything else about your order.
Exceptions: You may bring an individual claim in small claims court. Claims alleging sexual assault or sexual harassment are not subject to this arbitration clause under federal law.
This arbitration agreement is consistent with standard U.S. e-commerce practice. If any provision is found unenforceable, the remaining terms remain in full force.
